Insurance is a key (and often overlooked) part of any real estate or development financing. As something that forms a vital part of mitigating risk from a lender perspective, it is essential for deal parties to be are aware of how policies function and fit within the scope of a financing agreement.
This first element of the seminar is designed to provide an overview on insurance programme structure, which will cover the types of policies relevant to a real estate / development financings and what risks they are designed to insure against, alongside the purpose of the typical provisions / clauses which are specific to finance parties (in the context of the standard Facility Agreement wording). We will then run through the common challenges which can arise throughout the process, and how best to deal with these.
During the second part of the seminar, we will touch on some of the more specialist policies relevant to a real estate deal i.e. Title Indemnity, Rights of Light, Search Insurance, in order to provide a wider understanding of how insurance can help to mitigate specific legal risks identified during the DD process.
