We have published a 2022 update to our Due Diligence Guide for lending against UK real estate, available here.
The previous edition (published in 2019) expanded and updated the original 2013 version, in particular to cover more thoroughly the financing of construction and development, and to add material on UK tax and insurance as well as environmental aspects.
We are immensely grateful to all the contributors (identified at the front of the Guide) who made this possible, and especially to the leadership and coordination provided by Klaus Betz-Vais of Lloyds Bank and Simon Chadney of Herbert Smith Freehills LLP.
We want the Guide to be recognised by lenders and non-originating investors in CRE debt as a mark of good due diligence practice. To make the Guide more user friendly, our next task is to publish a due diligence checklist (linking to specific sections of the Guide) that can be more easily incorporated into lenders' due diligence processes.
We are also mindful of the neverending need for updates - most recently as a result of the UK's Economic Crime (Transparency and Enforcement) Act 2022 (see related News item here).
